Terms and Conditions of Use

The Company for Services APOD DOOEL Gevgelija, with registered office on Str. Marshal Tito G.T.C. No. 23, 1480 Gevgelija, with Company Reg. No. 7241720 (hereinafter referred to as APOD), allows you to use the services and contents of the Platform www.thrivity.mk in a manner determined by these Terms and Conditions of Use.

Definitions

Cartain expressions used in the Terms and Conditions of Use have the following meaning:
“Platform” – THRIVITY represents an ICT tool, application software, where people create Personal Profiles on the one hand and companies create Company Profiles on the other hand, according to strictly defined criteria, which the algorithm of the platform recognizes and combines accordingly.
“Terms and Conditions of Use” is the term for these Terms and Conditions of Use as well as their subsequent amendments and supplements which are binding on all Users who use the Platform;
“User” is any natural person or legal entity registered on the Platform and using its services and contents, and includes Companies and Individuals.
“Company” is a legal entity registered on the Platform for the purpose of using the contents of the Platform, labour market research and publication of advertisement/s for finding potential candidates for employment / engagement / internship / professional training.
“Personal profile” is a profile of a User who is a natural person, created for the purpose of using the contents of the Platform, as well as looking for a job/engagement/internship/professional training. Publication of one (1) advertisement applies to one (1) job position exclusively, from one industry, in one (1) or more cities.
“Active profile” is the personal profile of a User who has fully or partially filled in the data in the Platform, and who is looking for a job/engagement/internship/professional training, and for this purpose they chose the appropriate option and the Platform recognizes them in the matching process with the Companies.
“Passive profile” is a personal profile of a User who has fully or partially filled in the data in the Platform, but is not actively looking for a job/internship engagement/professional training, for which purpose they have chosen the appropriate option and the Platform does not recognize them in the matching process with the Companies.

Use of the Platform

Registration and use of the Platform by Users is free of charge. The service for automated selection and advertisement by the Companies is calculated and charged according to the valid Price List published on the Platform.

The Job search service is available for companies only and allows searching based on the criteria specified in the advertisement. The search results are displayed as statistical data, without identifying the Users and without the possibility for the Company to contact potential candidates. Conditions for using the job search service are listed in the Price List.

The Profile of the Companies is fully visible to all registered Users on the Platform and to visitors on the Platform who are not registered. The Company profile is partially visible with the following data: Company name, logo, address, country, contact, industry, only if the Company selects the appropriate option.

Company’s advertisement is published within the Platform, i.e. it will be visible and available to all visitors on the Platform, as well as publicly shared on the social media used by the Platform for promotion.

User’s personal profile, including all data that the User specified on the Platform, is visible only to the User of that Personal Profile, but if the User chooses the active profile option, the Platform will include it in the process of matching with Companies.

The Platform provides technical support to Users through an automated matching process in a manner that processes Filtering & Matching Criteria and provides an anonymous list of potential candidates for the respective job position with: matching percentage according to self-assessment of competencies, profile completion percentage, city, manner on which the candidate was proposed (according to current/last or next/desired job position), current status (employed or unemployed), date of matching with the advertisement and information on whether the candidate was previously invited for the same job position by the same company from the Users registered on the Platform with active personal profiles, to the Company that published the advertisement.


The company decides independently and at its discretion which of the proposed candidates from the anonymous list it will invite to apply and will send them an invitation that will automatically generate an SMS and/or e-mail through the Platform. The message will inform the User about the Company and the published advertisement and will inform them that they can apply for the open job position in the Company’s advertisement by clicking on the application link. If the User accepts the invitation by Company to apply for a specific position, by clicking on the application link, the User’s personal profile with all personal data will be visible to the Company that sent the invitation and it will be considered that the User has applied to the advertisement for a specific job position.

APOD does not guarantee that the Personal Profile User will accept the invitation to apply for an advertisement by the Company. The Personal Profile User has full right and discretion to accept or reject an invitation to apply for an advertisement. If within 72 hours the Personal Profile User does not accept the invitation to apply for an advertisement for a specific job position, it will be deemed that the invitation has been rejected and the User will not be able to apply for the specific advertisement in that manner. Until the invitation to apply for an advertisement is accepted by the User, the Company that invited them will not be able to see the Personal Profile of that User.

The Company will only be able to see the profile / profiles of the User / Users who accepted the invitation to apply by clicking on the corresponding link in the message sent. Accepting the invitation to apply by the User/Users is neither a guarantee, nor an obligation for the Company for further contact, include in the selection process and select the User/Users for the job position advertised. Companies are obliged to properly comply with the provisions of the Law on Labour Relations and/or other applicable regulations, depending on the purpose, i.e. the position, when compiling and publishing announcements for positions, during the process of selection and the selection of candidate/s, as well as when entering into an agreement for employment, engagement, internship, professional training etc., and exercising the legal and contractual rights and obligations arising out of the contractual relationship. Using the Platform for any other purposes, except for those for which it is foreseen and intended is prohibited.

Personal Data Protection

By registering on the Platform, Users give their consent to APOD to process their personal data for purposes of using the Platform and for promotion of services and activities on the Platform. When the Company, for the needs of researching the labour market, employment/engagement/internship/professional training, compiles and publishes an advertisement according to predefined criteria, the Platform processes the filtering and matching criteria and generates a list of potential candidates with matching percentage. The list of Users (active Personal Profiles) received by the Company is encrypted and contains some filtering data (matching percentage according to self-assessment of competencies, profile completion percentage, city, manner in which the candidate was proposed (according to current/last or next/desired job position), current status (employed or unemployed), date of matching to the advertisement and information on whether the candidate was previously invited for the same job position by the same company) on the basis of which the Company cannot identify the User.

If the Company wants to contact any of the Personal Profiles Users from the list, it sends an invitation to apply for an advertisement, generated through the Platform as SMS and e-mail, which the User can accept or reject. If the Personal Profile User does not accept the invitation to apply for an advertisement for a specific job position within 72 hours, it will be deemed that the invitation has been rejected. When the invitation to apply is received, the Personal Profile User has the opportunity to have a detailed look at the advertisement of the Company that sent the invitation.

By accepting the invitation to apply for an advertisement for a specific job position, i.e. by clicking on the appropriate application link in the message sent, the Personal Profile User provides consent to personal data processing by the Company and only in that case the Personal Profile is visible to the Company with the entered data.

All Companies are obliged to comply with the principles of personal data protection and to take appropriate technical and organizational measures to ensure confidentiality and protection of the User’s personal data processing which they have accessed based on an accepted invitation to apply, in the selection process, communication with candidate/s or in any other manner. APOD will not be liable for unauthorized disclosure or any illegal forms of processing of Users’ personal data (personal profiles) by the Company and will be held harmless for compensation for any pecuniary and/or non-pecuniary damage that could directly or indirectly to be caused.

Intellectual Property

Trademarks, logos and slogans, contents, drawings published and used by the Platform, the interface (appearance) and design of the Platform, the source code for the software application, the APOD algorithm, as well as the databases resulting from operation of the Platform represent intellectual property of APOD according to the Law on Copyright and Related Rights and the Law on Industrial Property.

Copyright and related rights, as well as industrial property rights enjoy criminal, civil and misdemeanor protection.

Any type of unauthorized downloading, use, copying, modification, sale, distribution or other misuse of APOD’s intellectual property is strictly prohibited. In event of any type of abuse, APOD will be authorized to take all measures and actions in accordance with the law. Download, use, copying, modification, selling, distribution or abuse of the intellectual property published on the Platform and/or listed in the Profiles and Advertisements by third parties or Users without authorization is prohibited.

APOD will not be held responsible in case of violation of intellectual property rights of Users or third parties that was directly or indirectly inflicted by the use of the Platform.

Reliability of data, inappropriate content
and liability for damages

Entering and using reliable and appropriate data when creating and filling in Profiles, as well as when compiling and publishing advertisements, is the duty and full responsibility of the Users.

We encourage our Users to regularly add, modify, or update their data on the Platform.

APOD reserves the right to, after a proper report, block and remove i.e. delete a fake User Profile or a Profile through which abuse is carried out, without prior notification and justification. APOD reserves the right to, after a proper report, remove or delete a published advertisement of a User with untrue, inappropriate, immoral or offensive content, without prior notice and explanation. The platform, i.e. APOD, is not responsible for the content, truthfulness and accuracy of the data entered in the Profiles by the Users or specified in the published advertisements. The platform, i.e. APOD, will be exempt from responsibility for compensation for any pecuniary and/or non-pecuniary damage that could be directly or indirectly caused due to use of unreliable data or misuse of data and/or advertisements by the Users.

Amendment, Acceptance of Terms and Conditions, Applicable Law and Jurisdiction

APOD reserves the right to amend these Terms and Conditions of Use, as well as to remove (temporarily or permanently), supplement or modify the services or any content on the Platform without prior notice. APOD reserves the right to, temporarily or permanently, cease the operation of the Platform, at any time and without prior notice. APOD is not responsible for any damage that may be caused in these cases.

By registering on the Platform, you declare that you have read and fully understood and accepted these Terms and Conditions of Use. By using the content and services of the Platform, it is deemed that the Users are familiar with these Terms and Conditions of Use at all times and that they fully understand and accept them. These Terms and Conditions of Use as well as all their subsequent amendments and supplements are binding on all Users who use the Platform.

When an amendment to the Terms and Conditions of Use is performed, we will revise the update date at the bottom of this page. Please visit the Terms and Conditions of Use from time to time to be aware of any amendments.

If you do not agree with these Terms and Conditions of Use and/or the Privacy Policy, please do not access and/or use our Platform.

To any issue between APOD and the Users, in addition to the provisions of these Terms and Conditions of Use and the Privacy Policy, the positive legal regulations of the Republic of North Macedonia also apply.

In case of potential disputes between APOD and the Users, which may arise from the use of the Platform, and which cannot be resolved amicably, the competent court in Skopje will be the competent court.
